THE PET SONG CREATIVE TERMS OF SERVICE

Welcome to The Pet Song Creative. By purchasing a custom song, using our website, or interacting with our services, you agree to the following Terms of Service. Please read them carefully.

1. Overview

The Pet Song Creative (“we”, “us”, “our”) provides custom music services inspired by pets. These Terms govern your use of our website, products, and services.

 

2. Eligibility

You must be at least 18 years old to purchase a custom song or submit information through our website.

 

3. Service Description

Our services include:

  • Custom songs inspired by your pet

  • Optional add‑ons (e.g., lyric sheets, album art)

  • Use of modern audio production tools (including Suno Studio, Ableton and FL Studio, which may include AI‑assisted features) as part of our creative workflow

All songs are written, directed, arranged, and produced by a human songwriter. 

We reserve the right to update or modify services at any time.

 

4. Customer Responsibilities

You agree to:

  • Provide accurate information about your pet

  • Not submit harmful, illegal, or offensive content

  • Not impersonate another person

  • Not misuse our website or services

 

We rely on information provided by the customer when creating custom songs and are not responsible for inaccuracies, omissions, or errors in information supplied by the customer.

 

5. Creative Process

You acknowledge that:

  • Songs are creative works and may vary in style, tone, and interpretation

  • You are purchasing a creative service, not a guaranteed outcome

  • Turnaround times are estimates, not guarantees

  • One round of revisions is included unless otherwise stated

  • We use a hybrid production workflow that may include AI‑assisted tools, but all creative decisions, lyrics, direction, and final production are human‑crafted 

  • The Client acknowledges that artistic preferences are subjective and that dissatisfaction with creative style alone does not constitute a defect in the service

 

6. Revisions

Revisions cover:

  • Minor lyrical adjustments

  • Small mix or timing tweaks

Revisions do not include:

  • Complete rewrites

  • New musical direction

  • Entirely new songs

Additional revisions may incur a fee.

 

7. Delivery

Songs are delivered digitally via email or download link.

We are not responsible for delivery issues caused by incorrect email addresses or spam filters.

 

8. Payment

Payment is required upfront.

We accept major payment methods via secure third‑party processors (e.g., Square, Stripe, PayPal).

 

9. Refunds

Refunds are governed by our Refund Policy (see refund policy page).

11. Portfolio Use

We will not feature your song, pet story, or related materials in our portfolio, website, or social media without your prior consent.

12. Governing Law:

These Terms are governed by the laws of Victoria, Australia. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Victoria.

13. Limitation of Liability

To the fullest extent permitted by law:

  • We are not liable for any indirect, incidental, special, consequential, or economic loss, including loss of profits, loss of opportunity, loss of goodwill, or emotional distress arising from the use of our services.

  • Our total liability arising out of or relating to the services is limited to the amount paid by you for the specific service giving rise to the claim.

  • Nothing in these Terms excludes, restricts, or modifies any rights or remedies that cannot be excluded under Australian Consumer Law.

 

14. Changes to Terms

We may update these Terms at any time. Continued use of our services constitutes acceptance of the updated Terms.
